1. Who we are

EQUALLYZE Solutions Ltda. ("Wally", "we", "our") provides the Wally platform — an automated solution for technical digital accessibility auditing in accordance with national and international standards (WCAG 2.2 levels A, AA and AAA; EN 301 549; Section 508; European Accessibility Act).

Wally provides:

• Automatic accessibility audits on websites and web applications (public and private);
• Detailed technical reports with diagnoses and actionable recommendations;
• CI/CD integration for continuous audit automation;
• Browser plugin for one-off audits;
• Cypress tests for accessibility assertions.

Important: Wally does not perform automatic corrections — we offer diagnoses and recommendations based on best practices. Implementation of corrections is the sole responsibility of the user.

3. Acceptance of Terms

By accessing and using Wally, you declare that you have read, understood and fully accepted these Terms of Use, as well as our Privacy Policy and Accessibility Policy.

If you are using Wally on behalf of a company, you declare that you are duly authorised to accept these Terms on its behalf, and undertake to bind the company to the terms established herein.

4. Permitted use of the platform

You undertake to:

• Use Wally only for lawful and legitimate purposes related to accessibility auditing;
• Not use the platform for fraudulent, abusive purposes or those that infringe third-party intellectual property rights;
• Comply with applicable laws, especially the European Accessibility Act, GDPR and accessibility regulations;
• Not audit third-party URLs without express authorisation from the site owner.

Violation: Failure to comply with these commitments may result in immediate suspension or cancellation of your account, without prejudice to legal actions and civil liability.

5. Registration and access

Some Wally features require account creation. You are responsible for:

• Providing truthful, complete and up-to-date information during registration;
• Maintaining the confidentiality of your credentials (password, API tokens);
• Notifying us immediately in case of unauthorised use of your account.

Equallyze is not responsible for improper access, data loss or damage resulting from negligence in caring for your credentials.

6. Intellectual property

All rights to content, design, algorithms, features, trademarks and intellectual property related to Wally belong to Equallyze or its licensors, protected by law.

It is expressly prohibited to:

• Reproduce, distribute, modify, create derivative works or reverse engineer the platform;
• Use Wally's trademarks, logos or trade names without formal written consent;
• Integrate, connect or host our algorithms on competing platforms.

7. Limitation of liability

Wally is provided "as available" and "as is". Within the limits permitted by law:

• We do not guarantee 100% accuracy in detections — Wally automates audits, but human insights may be necessary;
• We do not guarantee 24/7 availability (except under Enterprise contracts with SLA);
• We are not liable for indirect, incidental, consequential, punitive damages or lost profits;
• The use, interpretation and implementation of reports is the sole responsibility of the user.

Legal Compliance Notice: Wally reports do not constitute legal certification of compliance. For legal guarantees, consult a specialist in digital accessibility and regulatory compliance.

8. Privacy and data

We collect and process your personal data as set out in our Privacy Policy. By using Wally, you fully agree to this policy.

Audited URLs: We collect public URLs of analysed sites to improve our algorithms. This data may be processed for statistical purposes and never includes private site data.

9. Payments and Plans

Wally paid plans are subject to the following terms:

• Trial period: All plans include 30 free days without requiring a credit card;
• Cancellation: You can cancel at any time without penalty or cancellation fee;
• Refund: Refunds are processed according to the plan-specific refund policy;
• Price changes: We reserve the right to modify prices with 30 days' notice.

10. Account suspension or cancellation

We reserve the right to suspend or cancel your account immediately if we detect:

• Violation of these Terms of Use;
• Fraudulent or illegal activities;
• Attempts at unauthorised access to systems;
• Resource abuse or non-payment (after 30 days' notice).

11. Terms Updates

We may modify these Terms of Use at any time. Changes will take effect immediately upon publication on this page. If you continue to use Wally after the changes, you will be agreeing to the new Terms.

We recommend reviewing this page regularly to be aware of any changes.

12. Applicable law and jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the Federative Republic of Brazil, especially Law 13.146/2015 (Brazilian Inclusion Law) and LGPD.

The courts of Brasília - DF are elected to settle any disputes and litigation related to these Terms, to the exclusion of any other jurisdiction.
